Please read these Terms of Service ("Terms") carefully before using ScreenNab ("the Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ScreenNab, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ScreenNab is a free, browser-based screen recording tool that allows users to:

  • Record their screen, window, or browser tab
  • Capture webcam footage as an overlay
  • Record microphone and system audio
  • Edit recordings with trimming, cropping, and overlays
  • Export recordings as MP4 video files
  • Share recordings via temporary links (48-hour auto-deletion)
  • Optional end-to-end encryption with password protection

3. User Responsibilities

You agree to use ScreenNab only for lawful purposes. You are responsible for:

  • Consent: Obtaining consent from all parties before recording conversations, meetings, or other people's content
  • Copyright: Ensuring you have the right to record and share any content you capture
  • Privacy: Respecting the privacy of others and not recording without permission
  • Legal Compliance: Following all applicable local, state, national, and international laws

4. Prohibited Uses

You may not use ScreenNab to:

  • Record content without proper authorization
  • Violate any person's privacy or publicity rights
  • Infringe on copyrights, trademarks, or other intellectual property
  • Create, distribute, or store illegal content
  • Harass, stalk, or harm any person
  • Circumvent any access controls or security measures
  • Interfere with or disrupt the Service

5. Intellectual Property

The ScreenNab application, including its code, design, and branding, is owned by us and protected by copyright and other intellectual property laws.

You retain all rights to the content you create using ScreenNab. We claim no ownership over your recordings.

6. Privacy and Data

Your use of ScreenNab is also governed by our Privacy Policy. Key points:

  • Recording and processing happens in your browser by default
  • Your recordings are stored on your device unless you choose to share
  • Shared content is uploaded to our servers and deleted after 48 hours
  • We cannot access encrypted shared content

6A. Security and Encryption

ScreenNab offers optional end-to-end encryption for shared recordings. By using these features, you acknowledge and agree:

  • No Security Guarantees: Encryption features are provided "AS IS" without any warranty of security, effectiveness, or fitness for any particular purpose. We do not guarantee that encryption cannot be circumvented, broken, or compromised.
  • Implementation Limitations: While we use industry-standard encryption (AES-256-GCM), no encryption system is perfect. Security depends on factors outside our control including your device security, password strength, and browser implementation.
  • Password Responsibility: You are solely responsible for creating strong passwords and keeping them secure. We cannot recover forgotten passwords. Lost passwords mean permanent loss of access to encrypted content.
  • Not for Regulated Data: ScreenNab is not designed for data subject to regulatory requirements (HIPAA, PCI-DSS, classified information, etc.). Do not use for such data.
  • Sensitive Content Warning: For highly sensitive content, do not rely solely on our encryption. Consider additional security measures appropriate to your needs.

7. Disclaimer of Warranties

ScreenNab is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness
  • Uninterrupted or error-free operation
  • Security, encryption effectiveness, or data protection
  • Protection against unauthorized access or data breaches

We do not guarantee that the Service will meet your requirements or be available at all times.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or recordings
  • Loss of profits or revenue
  • Business interruption
  • Personal injury or property damage
  • Security breaches or unauthorized access to shared content
  • Failure of encryption or security features
  • Loss of access due to forgotten passwords

Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service (which is $0, as the Service is free).

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create using the Service

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
